Legal Framework

Fiji's Education Act 1966 (Chapter 262 of the Laws of Fiji) and the Compulsory Education Regulations 1997 (with the Compulsory Education Order 1997 and Order 1998) govern compulsory schooling. School attendance at Class 1 level is compulsory for all children turning 6 years old by 30 June of any year. Children must remain at school until they have completed Class 8 or Form 2 level of education, OR at the end of the year the child turns 15 years of age. Regulation 5 of the Compulsory Education Regulations 1997 addresses 'Special circumstances' and provides the basis for exemption from compulsory attendance, granted by the Ministry of Education on a case-by-case basis.
