Legal Framework

Federated States of Micronesia (FSM) education framework rests on: (1) Constitution of the FSM; (2) Title 40 of the FSM Code (national education law) administered by the National Department of Education (NDOE); (3) state-level education statutes for each of the four states (Yap, Chuuk, Pohnpei, Kosrae) — the state governments are constitutionally responsible for primary and secondary education provision. Education is compulsory for all children, including children with disabilities, from first grade through to graduation from the eighth grade, OR until the age of fourteen years — whichever comes first. Attendance is required at a registered public or non-public school. Homeschooling is not provided for as a recognised modality in the national or state codes.
