Legal Framework
Republic of China (Taiwan) Compulsory Education Act (國民教育法). Primary statute for homeschooling: Enforcement Act for Non-school-based Experimental Education at Senior High School Level or Below (高級中等以下教育階段非學校型態實驗教育實施條例), enacted 2014 with subsequent amendments. Article 4 recognises three forms of non-school experimental education (非學校型態實驗教育): (1) individual experimental education (個人實驗教育) — administered at home or other locations for a single student; (2) group experimental education (團體實驗教育) — administered at common hours and location for 3 or more students, capped at 30 students; (3) institutional experimental education (機構實驗教育) — administered by an incorporated, non-profit institute at fixed locations, max 25 students per class. Article 13 provides that the municipal/county/city competent authority shall make a conclusive decision on individual or group applications within 2 months of receipt, extendable by up to 1 month when necessary. Article 14 sets a 1-month decision timeline for institutional registration. Article 22 requires the competent authority to conduct a performance evaluation 3 months prior to the expiration of an institutional experimental education permit, with continuation requiring submission of a result report and continuation plan. The Act applies to persons qualified to enter elementary, junior high, or senior high school (Article 3).
